These Terms of Use ("Terms") govern your access to and use of the website www.donfruton.com and any related websites, content, courses, and services operated by Fruton Fire Consulting S.L. ("Company", "we", "us").
By purchasing or accessing any of our digital products, you agree to these Terms.
The Company provides online digital educational content, including courses, videos, and training materials (the "Content").
Unless otherwise specified at the time of purchase:
•Access to purchased courses is granted for lifetime use
•Access is provided immediately after purchase
"Lifetime access" refers to the lifetime of the product while it remains commercially available.
We reserve the right to update, modify, or improve the Content at any time.
3. RIGHT OF WITHDRAWAL
EU Consumers
Under EU law (Directive 2011/83/EU), you have the right to withdraw from your purchase within 14 days without giving any reason. However, by purchasing a digital product on this Site and accessing it immediately, you expressly request immediate performance and acknowledge that you lose your right of withdrawal once access to the Content has begun.
UK Consumers
If you are a consumer resident in the United Kingdom, you have the right to withdraw from your purchase within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015. The same waiver applies: by accessing the Content immediately upon purchase, you expressly consent to immediate performance and acknowledge the loss of your right to cancel once digital content delivery has begun.
Your statutory rights under UK law are not affected by these Terms.
4. REFUND POLICY
In addition to your statutory rights, the Company offers a voluntary 30-day refund policy. You may request a full refund within 30 days of your purchase, without providing a reason.
After 30 days, no refunds will be issued.
Refund requests must be submitted via email to [email protected] within the 30-day period. Refunds are issued to the original payment method. Upon issuing a refund, access to the purchased Content may be revoked.
5. REFUND ABUSE
The 30-day refund policy is offered in good faith to allow users to evaluate the Content. We reserve the right to take action in cases of abuse, including but not limited to:
•Repeated purchases followed by refund requests
•Excessive or systematic refund behaviour
•Behaviour indicating intent to use the Content without payment
•Sharing, copying, or distributing the Content
In such cases, we may refuse future purchases, suspend or terminate user accounts, or restrict access to current or future Content. We reserve the right to limit refunds to one per user, household, or payment method.
6. PRICING, TAXES & CURRENCY
Prices for our products may be displayed in USD or EUR depending on your location or your selection at checkout. The currency shown at checkout is the currency in which you will be charged and is final at the time of payment.
If you choose to pay in a currency different from your payment method’s default currency, your payment provider may apply currency conversion rates or additional fees. These are outside of our control and we are not responsible for any such charges.
EU Customers (VAT)
Prices displayed to EU consumers include Value Added Tax (VAT) where applicable, in accordance with EU VAT Directive 2006/112/EC. The applicable VAT rate depends on your country of residence.
Our EU VAT identification number is ESB67930495. For B2B transactions within the EU, the reverse charge mechanism may apply. If you are a VAT-registered business in another EU member state please provide your VAT number at checkout if applicable and technically supported at checkout by the paying platform. In such cases, VAT will not be charged and you will be responsible for accounting for VAT in your country under the reverse charge rules.
UK Customers (VAT)
Prices displayed to UK consumers include UK VAT where applicable, in accordance with HMRC regulations.
US Customers (Sales Tax)
Prices shown to US customers may be subject to applicable state and local sales taxes, which will be calculated and displayed at checkout where required.
7. LICENSE AND USE
When you purchase a course, you are granted a personal, non-exclusive, non-transferable, non-sublicensable licence to access and use the Content for your own personal, non-commercial educational purposes.
You agree:
•Not to share your account access with others
•Not to reproduce, distribute, or resell the Content
•Not to make the Content publicly available
•Not to use the Content for commercial training, instruction, or resale without prior written consent
Unauthorised use may result in termination of access without refund.
8. USER ACCOUNTS
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Accounts are strictly personal and may not be shared.
We may monitor usage patterns to detect simultaneous logins or abnormal access. If misuse or account sharing is detected, we may suspend or terminate access without refund.
9. ELIGIBILITY AND MINORS
You must be at least 18 years old to purchase or access our Content. If you are between 13 and 17 years of age, you may only access the Content with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.
We do not knowingly collect personal data from children under 13. If you believe a child under 13 has provided us with personal data, please contact us at [email protected] and we will delete it promptly, in compliance with the Children’s Online Privacy Protection Act (COPPA) and applicable law.
10. DISPUTE RESOLUTION (US CUSTOMERS)
If you are a US-based customer, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Content shall first be attempted to be resolved through informal negotiation by contacting us at [email protected].
If the dispute cannot be resolved within 30 days, it shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted remotely or, if an in-person hearing is required, at a location mutually agreed by the parties.
Class action waiver: To the maximum extent permitted by law, any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. If this waiver is found unenforceable, the arbitration clause shall be null and void.
11. FORCE MAJEURE
We shall not be liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including but not limited to acts of God, war, pandemic, cyberattacks, internet outages, or third-party failures.
12. AVAILABILITY
We aim to provide continuous access to the Content but do not guarantee uninterrupted availability. Access may be temporarily suspended for maintenance or technical reasons.
13. DISCLAIMER
The Content is provided for educational purposes only. We make no guarantees regarding results, learning outcomes, or language fluency. Your progress depends on your own effort, consistency, and application.
Nothing in our marketing materials or course descriptions constitutes a guarantee of specific outcomes. Any examples or results referenced are illustrative only and not typical.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Company’s total liability shall not exceed the amount you paid for the relevant course in the 12 months preceding the claim.
The Company shall not be liable for indirect or consequential damages, including loss of data, income, or opportunity.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
We process your personal data in accordance with Regulation (EU) 2016/679 (GDPR). You have the right to access, rectify, erase, restrict, or object to the processing of your personal data. Where we transfer personal data outside the EU, we ensure appropriate safeguards are in place, such as Standard Contractual Clauses.
UK Users (UK GDPR)
For UK residents, we process your data in accordance with the UK GDPR and the Data Protection Act 2018. Transfers of personal data from the EU to the UK are covered by the EU adequacy decision for the UK.
US Users (CCPA)
If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to delete it, and the right to opt out of its sale. 16. THIRD-PARTY SERVICES
We may use third-party services such as payment processors and hosting providers. We are not responsible for issues caused by these third parties.
17. GOVERNING LAW
These Terms are governed by the laws of Spain. Any disputes shall be subject to the courts of Madrid, Spain, unless otherwise required by mandatory consumer protection laws in your country of residence.
For EU consumers: Nothing in these Terms affects your rights under the mandatory consumer protection laws of your country of residence within the EU.
For UK consumers: Nothing in these Terms affects your rights under UK consumer protection legislation, including the Consumer Rights Act 2015.
For US consumers: The dispute resolution and arbitration clause in Section 10 applies.
18. CHARGEBACKS
You agree to contact us at [email protected] to resolve any issue before initiating a chargeback or payment dispute. Initiating a chargeback without first attempting to resolve the issue with us may be considered a violation of these Terms.
Abusive or fraudulent chargebacks may result in the suspension or termination of your account and restriction of access to current or future Content.
19. CHANGES TO TERMS
We may update these Terms at any time. Continued use of the Site constitutes acceptance of the updated Terms.
For material changes, we will endeavour to provide reasonable advance notice by email or via a prominent notice on the Site before the changes take effect.
